Terms of Service
The rules for using CapCrop
Last updated: 2026-06-30 (draft)
1. Agreement
These Terms govern your use of CapCrop, operated by [TODO: legal entity name and address]. By creating an account you agree to these Terms and to our Privacy Policy. If you don't agree, don't use CapCrop.
2. Accounts
You're responsible for the activity on your account and for keeping your credentials (or linked sign-in) secure, and for providing accurate information when you register. You must be at least 16 years old to use CapCrop; the service is not directed at children under 16.
3. The service
CapCrop turns scanned sheets of photos into individual, labeled, exportable pictures. Cutting, straightening, and organizing run on our servers without involving any AI. Two optional features — Auto-tag and Restore — send a selected photo to a third-party AI processor; see the Privacy Policy. CapCrop is a workspace, not a backup service — export anything you want to keep.
4. Acceptable use
You represent that you own or otherwise have the legal right to upload and process every photo you put into CapCrop. You agree not to upload, store, or attempt to process through any CapCrop feature:
- Content you don't have the right to use;
- Illegal content under applicable law, including, with zero tolerance, child sexual abuse material (CSAM) in any form — regardless of context or intent;
- Content that violates our AI partners' usage policies when you use a feature that routes through them.
CapCrop may, without prior notice: remove or restrict access to
content; suspend or terminate an account; and preserve and report
content to NCMEC or other authorities where we have a legal
obligation or good-faith belief that doing so is required — see
TRUST_AND_SAFETY.md. CapCrop is under no obligation to
pre-screen content; acceptance for upload, storage, or organizing is not
a representation that content complies with these Terms or will be
accepted by an AI feature.
Using Auto-tag or Restore binds you to our AI partner's usage policies for that request; violating them (for example, content their safety system flags) is a breach of these Terms.
5. Your content
You retain ownership of the photos you upload. By uploading, you grant CapCrop the limited right to store, process, and display that content back to you to provide the service. We don't claim ownership of your photos and don't use them to train any AI model.
[TODO: AI-output disclaimer — e.g. "we don't guarantee a restored image is historically accurate to the original, and you're responsible for reviewing AI-generated output before relying on it."]
6. Billing, credits, and refunds
Some features consume credits from one of two pools (text, image) unless you have an applicable free sample. Purchases are processed by Stripe. Your credit ledger is append-only and visible on the Billing page.
[TODO: refund stance — are purchased credits refundable, and what happens to an unused balance on account closure?]
7. Disclaimers and limitation of liability
[TODO: standard SaaS "AS IS" disclaimer + liability cap — needs counsel's template for the chosen governing-law jurisdiction.]
CapCrop is a workspace for processing copies of your photos, not a backup or archive — you are solely responsible for keeping your own copies of anything you don't want to lose.
8. Termination
You may stop using CapCrop and delete your account at any time. We may suspend or terminate your access for breach of these Terms (including §4), non-payment, or as required by law.
9. Changes to these terms
We'll update the date above when these Terms change.

10. Governing law and disputes
[TODO: governing-law jurisdiction and dispute-resolution mechanism.]
